ORDER : The Court made the following order :- The petitioner/A3, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 328 of IPC r/w Sections 6(b) and 24

(1) of Cigarette and Other Tobacco Act, 2003, in Crime No.429 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2.The case of the prosecution is that during regular patrolling, the respondent Police found that the accused persons were in illegal possession of banned tobacco products worth of Rs.12,690/- and arrested the first accused. Hence the case. 3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against her. Hence he seeks anticipatory to the petitioner.

4.The learned Additional Public Prosecutor appearing for the respondent submitted that during regular patrolling, the respondent Police found that the accused persons were in illegal possession of banned tobacco products worth of Rs.12,690/- and arrested the first accused. He also submitted that the petitioner has one previous case and hence, he objected to grant anticipatory bail to the petitioner. 5.Considering the nature of allegations levelled as against the petitioner and considering the previous bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
