To extend time for depositing the entire award amount with interests and costs to the credit of MCOP.No.440 of 2017 on the file of Motor Accident Claims Tribunal (Special Sub Court), Madurai pending disposal of the above civil miscellaneous appeal. 1/3

Prayer in CMA(MD). 990/ 2022 :

J-1. and J-26. Civil Miscellaneous Appeal filed under section 173 of Motor Vehicles Act to set aside the Judgment and decree passed in M.C.O.P. No. 440 of 2017 on the file of the Motor Accident Claims Tribunal, (Special Sub Court), Madurai, dated 23.11.2021.

ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.K.R.SHIVASHANKARI, Advocate for the petitioner in both CRL Mps, the court made the following order:- These applications have been filed to extend the time for depositing the entire award amount with interests and costs to the credit of M.C.O.P.Nos.439 and 440 of 2017 on the file of the Motor Accident Claims Tribunal (Special Sub Court), Madurai.

2. This Court, on 20.10.202, while granting interim stay, directed the appellant/Insurance Company to deposit the entire award within a period of four weeks from the date of receipt of a copy of that order.

According to the learned counsel for the petitioner/Insurance Company, the four weeks time expires on 01.12.2022. However, they deposited the amount on 03.12.2022 and 06.12.2022 respectively. Hence, she has filed the present applications.

4. In such a view of the matter, these applications are ordered. Interim stay already granted by this Court is extended till 24.04.2023.

5. Post these appeals on 24.04.2023.
