Crl.O.P.(MD)No.15066 of 2015 : Criminal Original Petition filed Under Section 482 of the Code of Criminal procedure praying to diret the 2nd respondent to file final report in Crime No. 192/2009 on the file of the 2nd respondent within a time framed by this Hon'ble Court.

ORDER

The petitioner has come forward with this contempt petition stating that the petitioner has filed a petition in Crl.O.P.(MD) No.15066 of 2015 seeking a direction to the respondent to investigate the matter and file a final report within the stipulated time and in pursuance of the order of this Court dated 06.08.2015, the contemnor is directed to file the final report within a period of two months from the date of receipt of a copy https://hcservices.ecourts.gov.in/hcservices/

of that order. After receipt of the order, the charge sheet has not been filed. After issuance of contempt notice, the present Contempt Petition has filed. Statutory notice has been issued.

2. After receiving contempt notice, the contemnor is present and filed a report stating that the investigation has been done and final report has been filed, which was taken on file as P.R.C.No.74 of 2016, dated 15.07.2016, on the file of the learned Judicial Magistrate No.VI, Madurai. Hence, report has been called for from the learned Judicial Magistrate No.VI, Madurai and a report has also been received, which shows that already final report has been filed and it was taken on file as P.R.C.No.74 of 2016.

3. The learned Counsel for the petitioner would submit that some of the jewels have not been recovered, however the respondent has filed the final report.

4. Here, the final report has been filed by the respondent and it is taken on file.

The contemnor also tendered his unconditional apology. Recording his unconditional apology, this Contempt Petition is closed and the contemnor is discharged from contempt.
