PRAYER: Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of a Writ of Mandamus, directing the respondents 1 to 3 herein to take immediate action to appoint (1) C.T.Ramesh, son of Chidambaram representing Andikarai Sect (2) S.P.Karuppaiah Ambalam s/o. Subbaiah Ambalam representing Thandavan Karai (3) S.Kannappan son of Chokkalinga Ambalam representing Kesavan Karai (4) T.L.Shanmugasundaram Ambalam s/o. Palaniappa Ambalam representing Ariyan Karai respectively as Trustees of the Natar Trust situated at Kandanoor Village, Sivagangai District by considering the representation sent by the petitioner, dated 30.11.2017 within the time stipulated by this Court. O R D E R

The writ petitioner, namely, Chinnayya Ambalam who belongs to Nattar Sect, Aandikarai group has filed this writ petition in the year 2017 for a Mandamus directing the revenue officials to appoint four persons as trustees of Nattar Trust, Kandanoor Village, Sivagangai District by considering his representation dated 30.11.2017. 2/5

2.Today(20.12.2023), when this writ petition is taken up for hearing, there is no representation for the petitioner. 3.The learned Government Advocate appearing for the respondents 1 to 3 submits that the petitioner herein has filed another writ petition in the year 2019 in WP(MD) No.20865 of 2019 for a Mandamus directing the Commissioner, HR & CE Department to exercise his powers under Section 3 of the HR & CE Act and to take over the management of the above Trust. In the said writ petition, this Court, by order dated 09.03.2022 has passed an order directing the Commissioner, HR & CE Department to consider the petitioner's representation within a stipulated time. Accordingly, the Commissioner has passed an order appointing a fit person to the Trust. Challenging the said order, the trustees have filed a writ petition in WP(MD) No. 10890 of 2023. This Court has entertained that writ petition and granted an order of interim stay by order dated 16.08.2023. 3/5

4.Considering the relief sought for by the petitioner in this writ petition and considering that there is no representation for the petitioner and also taking into consideration of the further developments as stated by the learned Government Pleader, this writ petition is closed. No costs.
