PRAYER :- For Anticipatory Bail in Crime No.616 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/Sole Accused, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Sections 294(b) and 307 of 1/3

IPC, in Crime No.616 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant's son is the victim, who got divorce from his wife due to misunderstanding. Thereafter, he developed friendship with one Vanitha. On that ground, the defacto complainant's family demanded her family to marry her. But, the petitioner, who is the paternal uncle refused the same and attacked the victim, thereby, he sustained injuries and admitted in the hospital. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. 4.The learned Additional Public Prosecutor appearing for the State would submit that the injured in this case is still in hospital as inpatient and taking treatment. Hence, he opposed the grant of anticipatory bail to the petitioner. Further, the anticipatory bail application filed by the petitioner was dismissed by this Court in Crl.O.P(MD) No.17046 of 2023, dated 27.09.2023. 5.Considering the grievous nature of injury, there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3
