PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to pay the petitioner interest at the rate of 6% per annum, for the period of delay from 01.07.2022 to 30.05.2023, in paying the amounts paid towards the terminal and pension benefits of the petitioner namely, EPF Employees's Contribution, Gratuity, Encashment of Leaves and Commuted Value of Pension, within a time frame as may be fixed by this Court and without affecting his right to claim balance amounts towards those benefits.

O R D E R

The present Writ Petition has been filed by a "Special Grade Conductor Level-5" seeking a mandamus directing the respondents to pay the interest at the rate of 6% per annum due to the belated payment of terminal benefits. The petitioner had attained superannuation on 30.06.2022 and retirement benefits were disbursed only on 30.05.2023. The petitioner has sent a representation to the respondents on 17.08.2023, seeking interest for the said belated payment of terminal benefits.

2. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.

3. Considering the above said facts, the respondents are directed to settle the interest for the belated disbursement of the terminal benefits at the rate of 6% p.a., from the date of the petitioner's retirement till the date of 2/4

realization within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above said observations, this Writ Petition stands allowed. There shall be no order as to costs.
