ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 19.09.2024 for the alleged offence under Sections 7 of the Protection of Children from Sexual offences Act, 2012 r/w. Section 8 of the Protection of Children from 1/3

Sexual Offences Act, 2012, in Crime No.44 of 2024, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner is the neighbour of the victim girl. On the date of incident, the petitioner is said to have sexually assaulted the victim girl. Hence, the case.

3. Heard the learned counsel on either side and perused the materials placed on record.

4. The learned Additional Public Prosecutor submitted that the investigation has been completed and police report was filed on 28.10.2024 before the learned Principal Special Court for Exclusive Trial of Cases under POCSO Act, Madurai and the same is yet to be taken on file.

5. Taking into consideration the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail at this stage. There must be some progress in the trial and atleast the victim girl should be examined before the Trial Court before considering the bail petition of the petitioner.
