PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to to direct the fourth respondent to expedite the investigation and to issue look out notice to the accused persons in Crime No.153/2022 dated 11.05.2022 on the file of the fifth respondent within a stipulated period as framed by this Court.

ORDER

This criminal original petition has been filed seeking a direction to the fourth respondent to expedite the investigation and to issue look out notice to the accused persons in Crime No.153 of 2022, dated 11.05.2022, on the file of the fifth respondent.

2.As rightly pointed out by the learned Counsel appearing for the petitioner, this Court in Crl.O.P(MD)No.19015 of 2022, vide order, dated 11.11.2022, directed the Superintendent of Police, Tuticorin, to supervise the investigation in Crime No.153 of 2022 by nominating an Officer not below 2/6

the Rank of Deputy Superintendent of Police and see it that the investigation conducted in all fairness and final report is filed within a specified time before the Court of the learned Judicial Magistrate concerned. 3.The learned Government Advocate(Crl.Side) would submit that in pursuance of the order of this Court, the Superintendent of Police, Thoothukudi, has issued the proceedings, dated 14.12.2022, directing the Deputy Superintendent of Police, ALGSC, i/c District Crime Branch to conduct further investigation and file final report, within a specified time before the concerned Judicial Magistrate Court and that the investigation is pending.

4.Recording the said submission, the Deputy Superintendent of Police, ALGSC, i/c District Crime Branch, Thoothukudi District, is directed to complete the investigation and file final report before the jurisdictional Court, within a period of two months, from the date of receipt of a copy of this order. 3/6
