Prayer in WP(MD). 18365/ 2015 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a WRIT OF CERTIORARIFIED MANDAMUS to call for the records on the file of the respondent in connection with the impugned panel for promotion to the post of Diesel Mechanic cum Fitter issued in Se.Mu.No. Me.Pa.5/21727/14 dated 15.07.2015 in so far as rejecting the Petitioner and quash the same as arbitrary and ultravires and consequently direct the respondent to promote him to the post of Diesel Mechanic cum Fitter for the year 2014 and pay all service and monetary benefits.

ORDER

This Court, by the order dated 13.10.2015, issued a direction to the respondent to give promotion to the petitioner without reference to the departmental proceedings initiated under Rule 17 (a) of the Tamil Nadu Civil Services (Discipline & Appeal Rules). https://hcservices.ecourts.gov.in/hcservices/ 2.Contending that there is non-compliance of the order and the conduct exhibited by the respondent amounted to willfull

disobedience to the order passed by the Court, the present Contempt Petition has been filed.

3.The Learned Government Advocate appearing for the respondent submitted that as against the order passed in W.P(MD)No.18365 of 2015, dated 13.10.2015, a writ appeal in W.A(MD)No.935 of 2016 has been filed and the matter has been stayed by the Division Bench of this Court.

4.In view of the same, this contempt petition is closed for the time being.
