PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of of Certiorari, to call for the records pertaining to the impugned order in Roc.A2/4606/2009 dated 03.10.2017 on the file of the Respondent No.1 and the consequential Impugned order in Na.Ka.1/176/2017 dated 10.11.2017 on the file of the Respondent No.4 and quash the same as illegal.

O R D E R

This Writ Petition has been filed challenging the impugned order dated 03.10.2017 passed by the first respondent and the consequential order dated 10.11.2017 passed by the fourth respondent terminating the petitioner from the service.

2. The petitioner has challenged the impugned orders primarily on the ground that since Crl.A.(MD).No.315 of 2017 is pending before this Court and that the petitioner had challenged the conviction order passed by the Criminal Court in the said Criminal Appeal, the question of terminating the petitioner from service under the impugned order does not arise. 2/5

3. However, it is now brought to the notice of this Court by the learned Special Government Pleader appearing for the respondents that the Criminal Appeal filed by the petitioner has also got dismissed on 20.12.2022 by this Court.

4. In view of the same, relief sought for by the petitioner in this Writ Petition cannot be granted as a ground raised in the same does not arise any more.

5. Accordingly, there is no merit in this Writ Petition and the same stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
