Elangeshwaran ....Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondent No.5 to survey the petitioner's property in Patta No.887, Survey No.104/12B2 in Kattathi Village, Karambakudi Taluk, Pudukkottai District on the basis of the petitioner's survey receipt challan No.20250605014026 and consequently direct the respondent No.7 provide police protection for conducting survey in accordance with law within the time stipulated by this Court.

By this writ petition, the petitioner seeks conduct of the survey of the lands in S.No.104/12B2.

2.Learned Special Government Pleader accepts notice on behalf of the respondents 1 to 5. By referring to page No.31 of the typed set of papers, he points out that the survey was conducted on 19.05.2025 in respect of the above mentioned land. He further submits that the petitioner has an appellate remedy, if dissatisfied with such survey.

3.The Tamil Nadu Survey and Boundaries Act, 1923 provides for an appellate remedy before the Assistant Director of Survey. Therefore, I am not inclined to entertain this writ petition.

4.Accordingly, this writ petition stands disposed of by leaving it open to the petitioner to file an appeal in accordance with the statute. No costs. 16.09.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/5
