O R D E R
This Civil Revision Petition is filed as against the docket order of the the learned Subordinate Judge, Padmanabapuram, Kanyakumari District, dated 22.07.2022, returning the plaint filed by the petitioners for certain compliance.
2.Today(23.12.2022), when the matter is taken up for hearing, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this Civil Revision Petition with liberty to correct the defects pointed out by the trial Court and to represent the plaint. 3.In view of the above, this Civil Revision Petition is dismissed. However, the petitioner is at liberty to re-present the plaint after compliance. If the trial Court is not satisfied with the compliance, the trial Court shall provide an opportunity to the petitioner to rectify 2/4
the defects and comply with the same in the open Court, as per the order passed by this Court in the case of D.Parameswari and another Vs.Sathya and another, in CRP(PD) No.1546 of 2019, dated 25.04.2019. Registry is directed to return the original plaint to the petitioners with due acknowledgment, enabling them to re-present it before the trial Court. No costs.
