Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 to consider the representation dated 14.08.2022 and restrain the 6th respondent from making hindrances to our trust, devotees and workers involved in the construction works and his try to collect donations from the public.

ORDER

Heard the learned counsel for the petitioner, the learned Special Government Pleader for the respondents 1 to 3 and the learned Government Advocate (Crl. Side) for the respondents 4 and 5. 2.The sixth respondent herein filed O.S.No.192 of 2020 on the file of the learned Principal District Munsif Court, Tiruchirappalli seeking the relief of permanent injunction in respect of the affairs of the petition mentioned trust. The petitioner is figuring as eighth defendant in the said suit. The petitioner 2/6

has to necessarily work out his remedies only in the pending suit. Even if the petitioner is defendant, he can very well maintain an interlocutory application. It is seen that the petitioner has already filed such an interlocutory application. The learned Principal District Munsif, Tiruchirappalli is directed to number the same and give a disposal on merits and in accordance with law. I have not gone into the merits of the matter. When the petitioner has already filed an interlocutory application, the question of parallelly moving the Writ Court does not arise.

4.With the aforesaid direction to the learned Principal District Munsif, Tiruchirappalli, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
