Contemnors/Respondents PRAYER: Contempt Petition filed under section 11 of the Contempt of Courts Act, to initiate contempt proceedings against the contemnors/respondents and punish the respondents for their willful disobedience of the order passed by this Court in W.P.(MD) No.22560 of 2015 dated 16.12.2015.

Prayer in WP(MD). 22560/ 2015 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a WRIT OF CERTIORARIFIED MANDAMUS calling for the records pertaining to the impugned order passed by the 2nd respondent in Ref.No.Nirvagam/A5/103/2015 Madurai Region-Administrative Department dated 30.06.2015 and consequential charge memo issued by the 2nd respondent to the petitioner in Ref: O.Na.Thu/D4/Thi.Pa.Ku/2112, 2114 dated 21.07.2015 quash the same and consequently direct the respondents to settle all the terminal benefits of the petitioner including gratuity, leave salary, commuted value of pension, provident fund, Social Security Scheme Amount and all other attendant benefits together with interest at the rate of 18% per annum payable from 30.06.2013 to till the date on which the above terminal benefits were settled. https://hcservices.ecourts.gov.in/hcservices/

The contempt petition has been filed to commit and punish the respondents for their willful disobedience of the order passed by this Court in W.P.(MD)No.22560 of 2015, dated 16.12.2015. 2.Heard Mr.A.Rahul, learned counsel for the petitioner and Mr.A.P.Muthupandian, learned standing counsel for the respondents. 3.The learned counsel for the contemnors would submit that the entire benefits have already been paid to the petitioner and they undertake to pay the commutation and pension arrears within a period of two months from the date of receipt of copy of this order. In case of non-compliance, the petitioner can revive the contempt application.

4.Recording the above submission, this contempt petition is closed with liberty to the petitioner to revive the contempt petition, in the event of non-compliance. No costs.
