2022 Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S. KALAIYARASI BHARATHI.P, Advocate for the petitioner and of M/S.M.VEERANTHIRAN, Government Advocate(Crl.side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the condition imposed in respect of payment of maintenance of Rs.10,000/- passed in Crl.O.P. (MD)No.16186 of 2021, dated 26.07.2022 on the file of this Court. 2.The learned counsel for the petitioner would submit that the petitioner is genuinely interested in living with the wife. 3.The learned Government Advocate (Crl. side) would submit that this Court, while granting anticipatory bail to the petitioner, had directed the petitioner to deposit a sum of Rs.
10,000/- as maintenance to the wife and children till further orders to be decided by the competent Court, on or before 10th day of every English Calender Month. However, the petitioner has not paid the monthly maintenance amount to the wife and children. https://www.mhc.tn.gov.
Crl.MP(MD)No.16306 of 2022 4.Heard. Perused the materials available on record. 5.Considering the facts and circumstances of the case and also considering the fact that the petitioner has not complied with the order passed by this Court dated 26.07.2022 in Crl.O.P.(MD)No.16186 of 2021, this Court is not inclined to modify the said condition. 6.Accordingly, this Criminal Miscellaneous Petition is dismissed.
