PRAYER: Criminal Original Petition filed under Section 528 of BNSS to transfer the investigation in Crime no.148 of 2024 on the file of second respondent police to some other investigating agency. For Petitioner : Mr.Ka.Ramakrishnan For Respondents : Mr.A. Thiruvadikumar No.1 & 2 Additional Public Prosecutor

ORDER

This petition has been filed seeking direction to transfer the investigation in Crime No.148 of 2024 on the file of second respondent police to some other investigating agency.

2. Today when the matter is taken up for hearing the learned Additional Public Prosecutor would submit that based on the complaint given by the defacto complainant the respondent police conducted enquiry and closed the complaint as ' undetected '.

3. The learned counsel for the petitioner would submit that no RCS notice has been served on him.

4. Recording the aforesaid submission, this Criminal Original Petition stands dismissed. Further the respondent police is directed to serve RCS notice to the defacto complainant forthwith and on receipt of the same, the petitioner is at liberty to approach the concerned court by way of protest petition in the manner known to law. Consequently connected miscellaneous stands closed. .
