PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to direct the learned Judicial Magistrate No.II, Madurai, to expedite the trial of the case in C.C.No.393/2021 pending before the learned Judicial Magistrate No.II, Madurai District, on a day to day basis for examining the listed of witness without giving frequent adjournments and dispose the case within a time frame limit fixed by this Court.

ORDER

This Criminal Original Petition has been filed seeking direction to the learned Judicial Magistrate No.II, Madurai, to expedite the trial of the case in C.C.No.393/2021 pending before the learned Judicial Magistrate No.II, Madurai District, on a day to day basis without giving frequent adjournments and dispose the case within a time frame limit fixed by this Court.

2.The petitioner is the defacto complainant in the C.C.No.393 of 2021. He gave a complaint before the respondent police, which was registered in Crime No.12 of 2020, for the offence punishable under Sections 406, 420, 468, 294(b), 506(i) of IPC and Section 66 A(a) of IT Act. The grievance of the petitioner is that though the case was registered in the year 2020, so far no progress is made in the trial process. Now it is posted for arguments, in Cr.M.P.No.9012 of 2021 in C.C.No.393 of 2021.

3.The learned Government Advocate (Crl. Side) would submit that totally thirteen witnesses to be examined in this case. He would further submit that the respondent police is ready to co-operate to complete the trial process within the time stipulated by this Court. 4.In view of the submissions on either side, there shall be a direction to the learned Judicial Magistrate No.II, Madurai, to expedite the trial process and dispose of the same within a period of five months from the date of receipt of a copy of this order. 5.With the above said directions, this criminal original petition is disposed of.
