ORDER

Heard both sides.

2.The petitioner is a party to the partition deed. When the document was presented for registration, registration was refused by citing the bar under Section 22A of the Registration Act, 1908. 3.I made it clear that I will not quash the refusal check slip. This was primarily because the parties had, on their own, formed a road and shown it as boundaries.

4.The petitioner now submits that in the revised partition deed no road will be shown as one of the four boundaries. That apart, he has also undertaken that no housing or any other development can take place without getting permission form the competent authority. This undertaking will run with the land.

5.Subject to the parties adhering to the aforesaid undertaking, they may present the revised partition deed. The same will be accepted for registration. It shall be registered and released subject to the fulfilment of the other usual formalities. I make it clear that the stamp duty issue is not dealt with in this writ petition.
