For Respondent : Mr.RMS.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.517/2023 on the file of the respondent police. ORDER : The Court made the following order :- 1/3

The petitioners / accused apprehending arrest at the hands of the respondent police for the offences punishable under sections 4(1)(aaa) and 4(1-A) of TN Prohibition Act in Crime No.517 of 2023 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioners herein and other accused have illegally found in possession of 100 litters of Liquor (Kallasarayam) and hence, the complaint.

3. The leaned counsel appearing for the petitioners would submit that the petitioners is innocent and they have not committed any offence as alleged by the prosecution and their names have been falsely implicated in this case and hence, he seeks anticipatory bail.

4. The learned Additional Public Prosecutor would submit that petitioners herein and other accused have illegally found in possession of 100 litters of Liquor (Kallasarayam) and hence, he strongly, opposed to grant anticipatory bail to the petitioner.

5. Considering the serious nature of allegations made against the petitioners and also the submission made by the learned Additional Public Prosecutor appearing for the respondent, this Court is not inclined to grant anticipatory bail to the petitioner.
