ORDER

The present writ petition is filed to quash the impugned refusal check slip in RFL/Paramakudi/29/2022 dated 09.12.2022 on the file of the first respondent and consequently, to direct the respondent to receive and register the sale deed executed by the petitioner in favour of S.Tamil Arasi. 2.The impugned order states that it is a Government land. 3.However, the learned counsel appearing for the petitioner vehemently submitted that there is no record to state that the land belongs to the Government. Further, there were four previous documents registered in the same survey number. Therefore, there is no record to state that the said S.No.243/2, belongs to the Government property. He further submitted that 'A' Registrar states that it is a ryothwari nanjai. In this regard, he has produced extract of 'A' Registrar. 4.However, the learned Additional Government Pleader appearing for the official respondents submitted that as per the Government records, it is classified 2/5

as Government land.

5.After hearing the elaborate argument made on either side, this Court has already impleaded the Tahsildar as the second respondent on 25.09.2024. Hence, the impugned refusal check slip in RFL/Paramakudi/29/2022 dated 09.12.2022 passed by the first respondent is hereby quashed. The petitioner shall submit all the relevant records regarding the disputed land. Thereafter, the first respondent/Sub Registrar is directed to take a clarification from the Tahsildar/2nd respondent and thereafter, the first respondent shall consider all the records, including the records submitted by the petitioner and pass orders in accordance with law, after hearing the petitioner. The said exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. 6.With the above observations, this writ petition stands disposed of. There shall be no order as to costs.
