Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus, directing the first respondent herein to re-fix the petitioner seniority as per his entry into service and grant his service and other monetary benefits as per the orders of the Learned Labour Court, Madurai in I.D.No.31 of 2001 which was confirmed by Honourable High Court in W.A.(MD)No.16 of 2013 with all consequential service and monetary benefits, based on the representation dated 22.12.2015.

O R D E R

This Court, by order dated 21.01.2016, in W.P.(MD).No.1234 of 2016 directed the respondent herein to consider the representation of the petitioner dated 22.12.2015 in the light of the judgment passed in W.A.(MD).No.16 of 2013 within a period of six weeks. Since the respondent herein has not complied with the same, the petitioner has come up with this contempt petition.

2.Today, when the matter was taken up for hearing, the learned counsel appearing for the respondent submitted that after consideration, the representation of the petitioner was rejected by the respondent on 23.05.2016 and thus, nothing survives in this contempt petition.

3.Recording the above submission of the learned counsel for the respondent, this contempt petition is closed. However, the petitioner is at liberty to challenge the rejection order, if he is so advised. No costs.
