O R D E R

This Writ Petition is filed seeking a Mandamus as against the respondent to consider the petitioner's transfer of Notary practice from Vellore to Vilavancode Taluk in Kanyakumari District, under Rule 8 (A) of Notary Rules 1956.

2. According to the petitioner, he was appointed as Notary in the Vellor District. The petitioner made a representation on 28.08.2023, seeking to transfer of practice area extension from Vellore District to Vilavancode Taluk in Kanyakumari District. Since the same was not considered till date, the petitioner has filed this Writ Petition.

3. The learned Additional Government Pleader appearing for the respondents would submit that the existing Notaries in Kanyakumari District are sufficient for the requirement of public. He further submits that already the petitioner's request for extension of area of practice to Kanyakumari District is rejected vide G.O.(RT)No.18, Law (Adminstration) Department, dated 11.03.2020. Therefore, without challenging the said Government Order, the petitioner cannot once again 2/4

seek transfer of Notary practice to Kanyakumari District. Hence, he prays for dismissal of this Writ Petition.

Considering the facts and circumstances of the case, this Court is of the view that already the petitioner's request for transfer of Notary practice to Kanyakumari District was rejected through the Government Order on 11.03.2020. Therefore, no Mandamus can be issued directing the respondents to consider the representation of the petitioner. However, petitioner is permitted to make a fresh representation, seeking transfer of Notary practice to Kanyakumari District, taking into consideration of the present development in that area and if any such representation is made, the authorities concerned shall consider and dispose of the same.

5. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
