Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to settle the retirement benefits of the petitioner including Gratuity the Commuted Value of Pension, Leave Salary based on the settlement under Section 12
(3) of the Industrial Act 1947 dated 13.04.2015 together with interest at the rate of 18% per annum from the date of his retirement to till the date of settlement within the time that may be stipulated by this Court and further directing the respondents to pay interest at the rate of 18% per annum for the belated payment of the Provident Fund and Social Security Scheme arrears within the time limit that may be fixed by this Court. This Contempt Petition has been filed to punish the respondents for willfully disobeying the order of this court made in W.P(MD)No.20931 of 2015, dated 21.01.2016. 2.When the matter is taken up for hearing, the learned counsel for the petitioner as well as the learned counsel for the respondents submitted that except interest on commutation, other benefits have been paid to the petitioner.
3.In view of the above submission, this Contempt Petition is closed with a direction to the 2nd respondent to pay interest on commutation, within a period of two months from the date of receipt of the order copy. In the event of non-compliance, liberty to the petitioner to revive the contempt. No costs.
