BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 09.12.2024

CORAM:

THE HONOURABLE MR.JUSTICE K.KUMARESH BABU N.Rajasekar ... Petitioner /vs./ The Commissioner, Madurai Corporation, Madurai 625 002.

... Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorari, calling for the records relating to the cancellation order passed vide in Ma.Va.30440/17 dated 08.12.2017 and quash the same as illegal.

For Petitioner : Mr.M.Sankar For Respondent : Mr.K.K.Kannan

ORDER

The challenge in the writ petition is to a communication given by the respondent to the Madurai District Milk Manufacturers' Union cancelling the permission granted to it for running a Milk shop. 1/3

2. A copy of the said communication had been marked to the petitioner, who had been granted permission to run the shop in the licensed place by the Milk society. The reason for cancelling the license given to the Milk society was that apart form the Aavin products, various other produces, which were prohibited, have also been sold in the said licensed place.

3. The licensee had not challenged the said proceedings. However, the person, who had been granted the permission to run the licensed place, had only challenged the proceedings. When the licensee had not challenged it, the person, who was permitted by the licensee, does not have the locus standi to challenge the said impugned communication.

4. In such view of the matter, I do not find any merits in this Writ Petition and accordingly, the Writ Petition stands dismissed. However, there shall be no order as to costs.
