Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents No.1 and 2 to take action against the 5th respondent pursuant to the recommendation made by the 4th respondent dated 08.08.2025 and seal the 5th respondent unit in the survey numbers 227/12A1B and 14A2, Muthoor Village, Kalayarkovil Taluk, Sivagangai District.

ORDER
Heard the learned counsel for the writ petitioner and the learned Special Government Pleader for the respondents 1 to 4. Issuance of notice to the fifth respondent is dispensed with. 2.The petitioner is a resident of Kullangudi Village. He alleges that the fifth respondent is commercially exploiting groundwater without proper permission. In this regard, the petitioner has already lodged a complaint. He wants action the initiated in the matter to be taken to its logical conclusion.

3.When the writ petition was taken up for admission, the learned Special Government Pleader submitted that spot inspection was conducted by the committee which included the fourth respondent also. The committee found that without getting any permission, the fifth respondent is carrying on his activities. The relevant papers have been placed before the second respondent. Notice has also been issued to the fifth respondent.
4.I direct the second respondent to issue notice to the fifth respondent. Let it be a seven days notice. The second respondent will hold a summary enquiry and pass final order on merits and in accordance with law within a period of three weeks from today ie., 16.09.2025. Since this writ petition is being disposed of at the admission stage itself by recording the stand of the learned Special Government Pleader and the fifth respondent has not been put on notice by me, it is clarified that the merits of the matter have not been gone into by me. The possible defences which the fifth respondent may have are left open and not foreclosed.
