The instant Writ Petition has been filed by the wife of the deceased Office Assistant working in the third respondent Office, seeking a Mandamus for disbursement of terminal and other monetary benefits of her husband based upon her representation, dated 16.07.2024.
2. According to the learned counsel appearing for the petitioner, the petitioner's husband was working as an Office Assistant in the third respondent Office and he was implicated in a criminal case in Crime No.38 of 2022, on the file of the Inspector of Police, Watrap Police Station, Virudhunagar District. Pursuant to the said criminal case, he was placed under suspension. The criminal case was quashed by this Court in Crl.O.P(MD) No. 11039 of 2023, by an order, dated 21.06.2023.
3. The petitioner's husband has given a representation to the third respondent on 22.07.2023 seeking reinstatement. However, before any order could be passed, the petitioner's husband had passed away on 15.07.2024. 2/5
Therefore, the petitioner has sent a representation on 16.07.2024 seeking the benefits of her husband. So far no orders have been passed by the third respondent.
4. Heard the learned counsel appearing for the petitioner, the learned Additional Government Pleader appearing for the respondents 1 and 2 and the learned Government Advocate appearing for the third respondent.
5. In view of the above said facts, the third respondent herein is directed to consider the representation of the petitioner dated 16.07.2024 and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
6. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs.
