Civil Revision Petition is filed under Article 227 of the Constitution of India to direct the learned Principal Subordinate Judge, Kumbakonam and to dispose as expeditiously in I.A.No.252 of 2019 in O.S.No.165 of 2017 on the file of the Principal Subordinate Judge, Kumbakonam.

ORDER

This Civil Revision Petition has been filed seeking a direction to dispose of the I.A.No.252 of 2019 in O.S.No.165 of 2017 on the file of the Principal Subordinate Judge, Kumbakonam within the time stipulated by this Court.

2. Heard the learned counsel appearing for petitioner. Since the revision is filed for seeking early disposal, no notice is necessary to the respondents.

3. The learned counsel appearing for the revision petitioner submitted that the 1st respondent / plaintiff filed the above said suit in the year 2017 for a scheme to be framed and settled for the proper management of suit Trust Sri Krishna Vilas Bajanai Kudam as per the terms of the Trust deed, dated 20.07.1896 and to remove the first defendant from the office of the Trusteeship from the suit trust and directing the 1st defendant to deliver the possession and surrender the accounts of his management and with cost and in the said suit, the 6th defendant filed an application in I.A.No.252 of 2019 for the relief to transpose the 6th defendant as the plaintiff and the same is being adjourned by the trial Court 2/5

for the past five years without assigning any valid reason and therefore, the said application may be disposed of within the time stipulated by this Court.

Having been taken into consideration of the material facts and circumstances and that the said application is pending from the year 2019, this Court is of the view that in the interest of justice, a direction may be issued to the learned Principal Subordinate Judge, Kumbakonam to dispose of application as expeditiously as possible.

5. Accordingly, this Civil Revision Petition is disposed of with a direction to the learned Principal Subordinate Judge, Kumbakonam to dispose of the I.A.No.252 of 2019 in O.S.No.165 of 2017 pending on his file within a period of one month from the date of receipt of a copy of this order on merits and in accordance with law.
