ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the learned District Munsif cum Judicial Magistrate, Alangudi to expedite the trial in C.C.No.3 of 2014 within the stipulated time that may be fixed by this Court.

2. In pursuance of the direction of this Court dated 20.12.2022, the learned District Munsif cum Judicial Magistrate, Alangudi has submitted a letter dated 05.01.2023 stating that after closing of the prosecution evidence, the accused were questioned under Section 313(1)(b) Cr.P.C. and the case was posted for defence side evidence, that the accused have filed a petition for recalling P.W.1 to P.W.6 for cross-examination and the same was allowed on 10.07.2015 and that when the case was pending for cross-examination of P.W.1 to P.W.6, Bailable Warrant was issued against the accused 1 and 2 and subsequently, Non-Bailable Warrant was issued against the accused 1 and 2.

Considering the above and also the fact that the case is pending from 2014 onwards, the respondent is directed to take necessary steps for executing the Non-Bailable Warrant at the earliest and after execution of the Non-Bailable Warrant, the trial Court is directed to proceed with the trial and complete the same as expeditiously as possible, preferably, within a period of two months from the date of surrender of the accused or the production of the accused on execution of the Non-Bailable Warrant.

4. With the above directions, this Criminal Original Petition stands disposed of.
