ORDER
The writ petition has been challenging the order passed in Na.Ka.No.A1/1369/2023 dated 19.05.2025 by the third respondent and to direct the third respondent to reinstate the petitioner into service. 2.The impugned order had been passed discharging the petitioner from service.
3.A perusal of the reference indicated in the impugned order would show that the petitioner had been issued with the show cause notice. The petitioner, who had been issued with the show cause notice, has submitted his explanation on 06.05.2025, which has also been acknowledged on 12.05.2025. However, the reply has not been considered by the third respondent and no further opportunity has also been given to the petitioner, before the impugned order came to be passed. Hence, the order impugned is liable to be set aside. 2/5
4.Mr.F.Deepak, learned Special Government Pleader for the respondents 1 and 2 would submit that the petitioner has now been placed under suspension, by proceedings, dated 14.10.2025 and a Charge Memo has also been issued as against the petitioner on 16.05.2025. If the petitioner is aggrieved against the order of suspension, it is open to him to challenge the same in the manner known to law.
5.In view of the aforesaid reasons, the impugned order passed in Na.Ka.No.A1/1369/2023 dated 19.05.2025 by the third respondent is liable to be set aside and is accordingly, set aside. The prayer sought for by the petitioner for reinstatement cannot be ordered, as the petitioner has been suspended. 6.In fine, the Writ Petition stands partly allowed. No costs. Consequently, connected Miscellaneous Petition is closed.
