ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 328 IPC r/w. Sections 6(b), 24(1) of Cigarettee and other Tobacco Products Act, 2003 in Crime No. 195 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that when the respondent police was in routine vehicle check up, the petitioner herein and other accused have found in possession of 30 pockets of Ganesh 701 Tobaco products. Hence, the case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and his name has been falsely implicated in this case.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that A1 has already been arrested and the petitioner herein is having 4 previous cases in similar nature of offence,

5. Considering the serious nature of allegations made against the petitioner and that he is having four previous cases in similar nature, he is not entitled for 2/3

discretionary relief of anticipatory bail.
