ORDER : The Court made the following order :- The petitioner / Accused No.8, who was arrested and remanded to judicial custody on 11.09.2024 for the alleged offence under Sections 8(c) r/w. 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985, in Crime No.11 of 2024, on the file of the respondent police, seeks bail.

2. The counter has been filed by the respondent. It is seen that the recovery of 1/3

120 kgs of ganja has been made from A1 to A3. Based on their confession, the other accused persons have been roped in this case. There are totally 10 accused persons in this case and the petitioner has been arrayed as A8. In the course of investigation, it has been ascertained that A1 and A10 had contacted A4 and had informed him that they will procure the ganja from Andra Pradesh. A4, in turn, is said to have got in touch with A7 to A9 who had agreed to smuggle the contraband to Sri Lanka by boat. The learned Additional Public Prosecutor submitted that various call details that took place between the accused persons has been secured and that the investigation is at a crucial stage.

In the considered view of this Court, considering the quantity of contraband involved and considering the fact that the investigation is pending in this case, this Court is not inclined to enlarge the petitioner on bail at this stage. On completion of investigation, based on the materials collected by the prosecution, it is left open to the petitioner to revive his claim for enlargement on bail.
