O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus, directing the respondents to issue Patta for the petitioner in Old Survey No.3153 lekkam 321 in Re Survey No.B7/95 of Padmanabhapuram Village, Kalkulam Taluk, Kanyakumari District admeasuring 1.897 cents on the basis of the judgment and decree in A.S.No.47 of 1124 M.E. of the Honble High Court Travancore - Cochin dated 30.01.1953.

2. Heard the learned counsel for the parties.

3. The petitioner submitted a representation dated 11.12.2017 to the respondents seeking issuance of patta in respect of the properties referred to above. However, no action has been taken on the said representation. Hence, the present writ petition has been filed.

4. Learned Additional Government Pleader, appearing on behalf of the respondents, submits that the petitioner's representation would be considered on merits and in accordance with law. 2/5

In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent/Tahsildar to consider the petitioner's representation dated 11.12.2017 on merits and in accordance with law and to pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

6. The representation shall be considered and disposed of after conducting an inquiry. The second respondent is further directed to afford a reasonable opportunity to the petitioner and to all other persons who may be affected by such decision during the course of the inquiry. In the event of any rival claims, the same can be agitated before the competent civil court. There shall be no order as to costs.
