PRAYER:Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondent to settle the difference in petitioner's terminal benefits namely gratuity, encashment of leave and all other attendant benefits if any based on the new wage settlement under section 12(3) of ID Act 1947 dated 24.08.2022 with revised pay matrix w.e.f. 01.09.2019 on the date of the petitioner retirement (for the period from 01.09.2019 to 30.09.2020) payable to the petitioner with 6% rate of interest. 1/4

ORDER
The instant writ petition has been filed by a retired employee of the respondent transport corporation, seeking a mandamus to pay the difference amount of his retirement benefits i.e., gratuity, encashment of leave and all other attendant benefits, based upon the 14th wage settlement on 24.08.2022 along with interest.

According to the learned Counsel appearing for the writ petitioner, the petitioner was joined in service in the respondent transport corporation and he voluntarily retired from service on 30.09.2020. He further contended that the 14th wage settlement was arrived on 26.08.2022. According to the petitioner, he is eligible to receive the said benefits and for revision of his pensionary benefits. Hence, the petitioner has sent a representation on 20.08.2024. Since, there is no response from the respondents, the present writ petition has been filed.

Considering the above said facts, the respondent Transport Corporation is directed to pay the eligible terminal benefits to the writ petitioner along with 6% interest from the due date till the date of disbursement within a period of twelve weeks from the date of receipt of a receipt of a copy of this order. 4.With the above said observations, this writ petition stands disposed of. No costs.
