ORDER : The Court made the following order :- The petitioner/Accused No.1 herein, who was arrested on 24.10.2023 for the alleged offence under Sections 25(1)(a) and 27(1) of Indian Arms Act, in Crime No.147 of 2023, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on receiving secret information, the respondent police went to the place of occurrence and at that time, the petitioner herein has threatened the public by showing the long sword. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case. 4.The learned Additional Public Prosecutor submitted that the petitioner herein has already been acquitted in the previous cases and thereafter, he is not having any bad antecedents and the co-accused have already released on bail. He would further submit that the investigation of this case is pending. 2/4
5.Considering the period of incarceration and that the co-accused have already released on bail, this Court is inclined to grant bail to the petitioner with stringent conditions.
6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Keeranur, Pudukkottai District, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
