O RDER This Criminal Original Petition has been filed to quash the First Information Report in Crime No.186 of 2022 pending on the file of the first respondent police.

2. On the ground that no stone was recovered only from the possession of the petitioner and also the concerned tractor bearing Reg.No. TN 69 L 4025 was recovered, this petition has been filed to quash the First Information Report in Crime No.186 of 2022.

3. The learned Government Advocate(Crl.Side) would submit that on the date of occurrence this petitioner abandoned the vehicle and fled away from the place of occurrence. When the vehicle was recovered it was found loaded with saral sand. It was produced before the concerned authorities and the vehicle was remanded before the concerned Court.

4. Recovery athatchi does indicate the availability or existence of sand at the time of seizure. The ground on which the case came to be filed does not 2/4

exist. Without any proper reason this petition has been filed,hence this petition is liable to be dismissed.

5. Accordingly this Criminal Original Petition stands dismissed.
