O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing the second respondent to cancel the patta issued to the fifth respondent in the petitioner's ancestor land situated in Survey No.437/4 in Vallarenthal revenue village, Thiruppuvanam taluk, Sivagangai district, based on the petitioner's representations 17.08.2023 and 01.11.2023.

When the matter was taken up for hearing, the learned Additional Government Pleader appearing for respondents 1 to 4 submitted that a fresh representation shall be filed before the second respondent/District Revenue Officer, who shall, in turn, consider and dispose of the same in accordance with law within the time frame stipulated by this Court.

In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the petitioner to submit a fresh representation before the second respondent/ District Revenue Officer, who shall consider and dispose of the representation of the petitioner dated 01.11.2023 on merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order.

4. Such representation shall be considered and disposed of after conducting an inquiry, affording a reasonable opportunity to the petitioner, the fifth respondent and to all other persons who may be affected by such decision during the course of the inquiry. In the event of any issues pertaining to land disputes, the parties shall approach the competent civil court. There shall be no order as to costs.
