Respondent PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to pay the petitioner the amount payable towards the encashment of 45.5 days of earned leaves, surrendered by him in the years before his retirement, as admitted in the settlement of account, dated 06.07.2022, either based on his monthly wages of the respective months of surrender of those earned leaves, together with 18% interest p.a. from the respective due dates or based on the monthly wages payable on the month of his retirement, together with 18% interest from the date of his retirement, within a time frame as may be fixed by this Court. ORDER

The present writ petition has been filed by a retired Senior Assistant who attained superannuation on 31.05.2022.

2. It is the contention of the writ petitioner that he has not been granted surrender leave encashment even after his retirement. The petitioner has sent a representation on 20.08.2023 seeking to settle the surrender leave salary.

3. In view of the above said facts, the respondent herein is directed to settle the eligible surrender leave salary to the writ petitioner within a period of twelve (12) weeks from the date of receipt of copy of this order along with 6% interest per annum from 01.06.2022 till the date of realization.

4. With the above said observations, this Writ Petition stands disposed of. No costs.
