ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 194 of BNSS, 108, 211 and 238 of BNS Act, in Crime No.94 of 2025 on the file of the respondent police. seeks anticipatory bail. 2.The case of the prosecution is that the Petitioner is the mother-inlaw of the deceased Narmathadevi. The 1st accused is the husband of the deceased. After the marriage between the deceased and the 1st accused, he had harassed the deceased. The Defacto complainant who is the elder sister of the deceased had pacified her. After birth of a female child, the deceased was subjected to be abused physically and mentally. When the parents of the deceased questioned about such harassment, the accused had demanded Rs.10,00,000/- and a car. On 17.06.

2025, the deceased was in her parents' house and she committed suicide on 17.06.2025 at about 04.30 a.m. Without informing the death of the deceased either to the police or to the other Government Officers they had taken the body to the native of the accused and they have completed the cremation by burnt her body. On 18.06.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent and she has been falsely implicated in this case. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks anticipatory bail.

4.The learned Additional Public Prosecutor submitted that the Petitioner is the mother-in-law of the deceased Narmathadevi. The 1st accused is the son of the 2nd accused. He further submitted that there is no previous case pending against the petitioner. However, he opposed for grant of anticipatory bail to the petitioner.

5. Taking into consideration of the facts and circumstances of the case and since the petitioner has complied with the conditions imposed in the interim anticipatory bail regularly, the interim anticipatory bail already granted is made absolute and this Court is inclined to grant 3/6

anticipatory bail to the petitioner, with certain conditions.:

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the Judicial Magistrate, Ponnamaravathy, within a period of fifteen days from the date of receipt of a copy of this order and on further conditions that:

[a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity; [b] the petitioner shall report before the respondent police as and when required for interrogation.

[c]the petitioner shall not tamper with the evidence or witness either during investigation or trial. [d]the petitioner shall not abscond either during investigation or trial.

[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
