... Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the order issued by the 1st respondent in 1/4
Letter Ref.No.IMP/315700969/23 dated 08.09.2023 and quash the same as illegal.
For Petitioner : Mr.K.P.Krishna Doos For Respondents : Mr.R.Senthil Kumar, Central Govt. Standing Counsel for R1.
Mr.A.Albert James, Government Advocate for R2 to R4.
ORDER
Heard both sides.
2.The petitioner is holder of Indian passport. It was impounded for the reason that an adverse police report was subsequently received. That led to the filing of this writ petition.
3.I called upon the learned Government Advocate to catalogue the cases in which the petitioner is involved. It is seen that all the cases are having political background and none of them are serious. I am clearly of the view that they are absolutely insufficient to warrant impounding the petitioner's passport. The impugned proceedings are quashed. The 2/4
writ petition is allowed. The petitioner's passport shall be returned immediately and without any delay. No costs. Consequently, connected miscellaneous petition is closed.
