Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, call for the records relating to the impugned Na.Ka.No.3095/2023/A2 dated 31.03.2024 on the file of the 5th respondent and quash the same on the ground that violating the terms and conditions of license and consequently to direct the 5th respondent to collect the entry tax in the Manapparai weekly cattle market based on the petitioner's representation dated 22.08.2025.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner seeks to quash the licence issued to the 6th respondent for collection of entry tax in the Manapparai weekly cattle market, based on the petitioner's representation dated 22.08.2025. 2/6

2. The grievance of the petitioner is that the 6th respondent is collecting amounts in excess of the amount fixed by the authorities for entering of the Cattle Market. In this regard, the petitioner had submitted a representation dated 22.08.2025. However, no action has been taken by the respondents. Hence, the present Writ Petition has been filed seeking to quash the licence granted to the 6th respondent.

3. Heard the learned counsel appearing on either side and perused the materials available on record.

4. On a perusal of the records, it is seen that, based on the complaint, an enquiry has already been initiated by the authorities. It is further seen that the authorities have not arrived at any conclusion that excess amounts were collected. However, appropriate directions have been issued to the 6th respondent to issue receipts for the fees collected and to display the nature and rate of fees in front of the market so as to enable the public to be aware of the same. It has also been directed that no amount in excess of the fee fixed by the Municipality shall be collected.

5. In view of the above, this Court is of the opinion that, in the absence of any material to establish collection of excess amounts, the licence issued to the 6th respondent cannot be cancelled. It is always open to the authorities to conduct further enquiry and, if any violation of the licence conditions is found, to take appropriate action in accordance with law.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
