ORDER
This Criminal Original Petition is filed to direct the 2nd respondent not to interfere in the civil dispute which is subject matter of O.S No. 38 of 2017 before the District Munsif court, Theni.
2. Learned Government Advocate (Crl.side) submitted that there is no complaint against the petitioner. A complaint given by the petitioner against the third respondent stating that pending the application on the file of the District Munsif Court, Theni, to restore the case in O.S.No.38 of 2017, the third respondent has made a construction in the disputed property. During the course of enquiry in the complaint, both parties appeared and the third respondent has given an undertaking that he will abide by the civil Court decree. On that basis the complaint was closed. 2/4
3. In view of the above submission, nothing survives for adjudication in this case. Accordingly, this Criminal Original Petition is dismissed as infructuous.
