Prayer: Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records on the files of the fourth respondent pertaining to its proceedings in Ku.Aa.No.1751/nib/u3/2024, dated 03.08.2024 and to quash the same and consequently direct the respondents to grant advance incentive increment for passing departmental test and pass such other or further orders as this Court.

ORDER

The present writ petition is filed to challenge the proceedings of the fourth respondent in rejecting the claim of the petitioner by referring to the proceedings No.16, dated 28.05.2020.

2. It has now been brought to the notice of this Court that by proceedings, dated 17.07.2025, the advance incentive increment either sanctioned or to be sanctioned to the employees were allowed to be continued in respect of the accounts officer, who have cleared the departmental test before 28.05.2020 and who are continuing their services in the accounts cadre.

In view of the communication of the first respondent, dated 17.07.2025, the order impugned, dated 03.08.2024 is set aside and the claim of the petitioner shall be reconsidered in line with the communication of the first respondent, dated 17.07.2025. Such exercise shall be carried out by the fourth respondent, within a period of four (4) weeks from the date of receipt of a copy of this order.

4. The writ petition stands disposed of with the above directions. There shall be no order as to costs. Consequently, connected Miscellaneous Petition stands closed.
