ORDER : The Court made the following order :- The petitioner/Accused No.4 herein, who was arrested on 07.07.2023 for the alleged offence under Sections 450, 395 r/w 397 r/w 34 of IPC, in Crime No.177 of 2008, on the file of the respondent police, in P.R.C.No.13 of 2017 on the file of the Judicial Magistrate No.II, Ramanathapuram, seeks bail. 2.The learned counsel for the petitioner submitted that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. 1/3

3.The learned Government Advocate (Crl.Side) would submit that after completing the investigation, final report was filed before the concerned Court. NBW was issued against the petitioner on 11.05.2017. On execution of the above said warrant, the petitioner was arrested on 07.07.2023. Already direction was issued by this Court to the committal Court to split up the case against this petitioner and complete the same.

4.Further, the learned Government Advocate (Crl.Side) would submit that the earlier bail application that was filed by this petitioner is dismissed in Crl.O.P(MD) No.16804 of 2023, dated 15.09.2023, considering the bad antecedent of the petitioner. 5.Considering the fact that there is no change of circumstances and two previous case is pending against the petitioner, among which, one is similar in nature, this Court is not inclined to grant bail to the petitioner.
