Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the respondents 1 and 2 to provide adequate police protection to the life and limb of the petitioner and to prevent any danger to the life of the petitioner and pass such other or further orders as this Court. ORDER
The petitioner has sought for a direction to the respondents to provide adequate police protection to the life and limb of the petitioner and to prevent any danger to the life of the petitioner in terms of the petitioner's complaint dated 21.08.2025.
2. The gist of the representation is that the petitioner had obtained permission from the Tahsildar to repair a water channel which was damaged by the third respondent.
3. The learned Additional Public Prosecutor, on instructions, would submit that against the order of the Tahsildar the third respondent has filed an appeal before the Revenue Divisional Officer and the same is pending and that therefore, the respondents 1 and 2 cannot grant police protection as sought for at this stage.
4. In view of the aforesaid submission, this Court is of the view that the respondents 1 and 2 cannot interfere and provide police protection as sought for at this stage. However, it is open to the petitioner to approach the Revenue 2/4
Divisional Officer to seek early disposal of the appeal. If the petitioner's right to repair the water channel is confirmed by the Revenue Divisional Officer, it is needless to state that the respondents 1 and 2 shall consider the petitioner's request on merits and in accordance with law.
5. With the above direction, this Criminal Original Petition is disposed of.
