Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 4 to consider the representation of petitioner dated 06.12.2022 and 13.02.2025 and consequently cancel the assignment pattas in Survey Nos.416/22, 416/23, 416/24, 416/26, 416/27, 416/28, with Patta No.742, 743, 744, 745, 746, 747 which is in violation of the conditions of assignment of lands. ORDER

The petitioner had applied for the cancellation of assignment pattas issued to the private respondents. This writ petition relates thereto.

2. In spite of service of notice on the private respondents and their names being printed in the causelist, there is no representation for respondents 5 to 14. Therefore, this writ petition is proceeded with in their absence. 2/4

3. Learned Government Advocate has handed over written instructions stating that the inquiry is pending before the Revenue Divisional Officer and that reports are awaited from the Revenue Inspector and the Village Administrative Officer.

4. Considering the said submissions, this writ petition is disposed of by directing the Revenue Divisional Officer to consider and dispose of the petitioner's request on merits within three months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and all the assignees concerned. It is made clear that no opinion has been expressed on the merits of the petitioner's request for cancellation. No costs. 27.11.2025 NCC : Yes/No Index : Yes / No Internet : Yes / No RJR 3/4
