The learned Government Advocate (Criminal Side) submits that on completing the investigation, charge sheet has already been laid on 10.09.2011.

In view of the above, nothing survives for consideration in this Criminal Original Petition, and hence, the Criminal Original Petition is dismissed giving liberty to the petitioners to challenge the final report. It is made clear that if such final report is not filed, it is open to the petitioners to re-open this Criminal Original Petition, since this Criminal Original Petition is dismissed on the said ground and not on merits. Consequently, connected Miscellaneous Petition is also dismissed.
