Mr.S.Ravi, Additional Public Prosecutor PETITION FOR BAIL UNDER SEC 483 of BNSS PRAYER :- To pass an order directing the Petitioner to be released on bail in connection SC No.838/2023 on the file of the Learned Assistant Sessions Judge, Valliyoor, Tirunelveli District in relation to crime No.143/2012 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner / Accused No.1, who was arrested and remanded to judicial custody on 15.05.2023 for the offence under Sections 341, 294(b), 324, 307 and 506(2) of IPC in SC No.838/2023 on the file of the learned Assistant Sessions Judge, 1/3
Valliyoor, Tirunelveli District, seeks bail.
2. This Court had earlier dealt with the bail petition filed by the petitioner on merits and dismissed the same in Crl.O.P.(MD).No.15375 / 2024 by an order dated 18.09.2024.
3. The learned Additional Public Prosecutor appearing for the respondent Police submitted that the examination of witness on the side of the prosecution has already been completed and questioning has already been done under Section 313 (1) (b) of Cr.P.C. He further submitted that an application has been filed to recall some of the witnesses.
4. Taking into consideration the facts and circumstances of the case and the earlier order passed by this Court, this Court is not inclined to enlarge the petitioner on bail. It will suffice if a direction is issued to the learned Assistant Sessions Judge, Valliyoor, Tirunelveli, to dispose of the case in S.C.No.838 of 2023, within a period of eight weeks from the date of receipt of a copy of this order and the learned Assistant Sessions Judge shall file a compliance report before this Court.
5. It is made clear that considering the time frame fixed by this Court, the accused persons will co-operate for completion of trial within the time frame. If delay is caused due to the attitude of the accused persons, the same cannot be taken advantage at a later point of time.
