ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(B), 29(1) of NDPS Act, 1985, in Crime No.11 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 30.07.2025 at about 21.30 a.m., Andipatti to Ethak temple road near north gate of railway bridge, the accused No.2 was found with 8 kgs of ganja and accused Nos.3, 4 and 5 have been found with possession of 8 kgs of Ganja. The joint possession of co-accused, ie., 16kg was seized and sample has also been taken. Hence, a case has been registered.

3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that there are three previous cases registered against the petitioner, among which two cases 2/4

are NDPS cases with commercial quantities and one case is NDPS case with non commercial quantity. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. In spite of the fact that the petitioner was found with possession of 16 kg of ganja which is below commercial quantity, this Court is not inclined to grant anticipatory bail to the petitioner for the sole reason that there are three previous cases against the petitioner which are similar in nature among which one case includes 110 kg of ganja.

6. Accordingly, this Criminal Original Petition is dismissed. 15.10.2025 TMG TO
