ORDER: The Court made the following order:- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offence punishable under sections 379 IPC and section 21(1) of the 1/4
Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.343 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 28/10/2023 at about 04.00 am, when the respondent police, on usual vehicle inspection at Puthupattinam ECR Road, at that time, the accused drove the four wheeler (Mahendra Max) No.TN-55-X-6588. The police, instructed him to stop the vehicle, but he did not stop the vehicle and run away from the scene of occurrence. After search, the alleged vehicle was seized with half unit of sand without getting any valid permission. Hence, this case. 3.Seeking anticipatory bail, the petitioner moved this petition on the medical ground that he sustained injuries; To show the same, medical certificate and photographs are also enclosed in form of types set of papers. 4.The learned Government Advocate (Criminal side) would submit that the petitioner is having one previous case in Crime No.37 of 2023 for similar nature of the offence.
5.But however, considering the fact that this petition is moved only on medical ground, this court is inclined to grant interim anticipatory bail to the petitioner for the period of one month from today (08/11/2023). Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the arresting officer on his executing a own bond for a sum of Rs.10,000/- (Rupees Ten 2/4
Thousand only) to the satisfaction of the arresting officer. After the one month period granted by this court, the petitioner must surrender before the respondent police immediately and seek regular bail in the manner known to law. 6.With the above said direction, this petition stands disposed of. sd/- 08/11/2023 / TRUE COPY / /11/2023 Sub-Assistant Registrar (C.S.)
