Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, praying to transfer the investigation from first respondent to second respondent in connection with Cr.No.10 of 2012 on the file of the first respondent. O R D E R

The petitioner is the son of the deceased in Crime No.10 of 2012 for the alleged offence under Sections 302, 380 of IPC, has come forward to file this petition.

2. When the matter came up for hearing today, the learned Government Advocate (Crl. Side) submitted that the status report has been filed, stating that the case was closed as undetected and FIR has also been filed before the learned Judicial Magistrate, Rameswaram.

3. Considering the nature of the alleged offences, this court is of the view that this is a fit case to transfer the investigation to the second respondent as it is imperative to fix https://hcservices.ecourts.gov.in/hcservices/

the accused especially when there is a doubt on the nature of the death of the deceased.

4. Accordingly, the first respondent is directed to transfer the entire file in Crime No.10 of 2012 to the second respondent for the purpose of conducting further investigation.

5. With the above direction, this Criminal Original Petition is disposed of.
